The Committee of the state Duma supported the draft law on remote work

The state Duma Committee on labour and social policy recommended that the lower house of Parliament adopted in first reading the draft law on regulation of remote work. The decision was taken at the Committee meeting on Wednesday.

The draft on regulating remote work was submitted to the state Duma the Chairman of the state Duma Vyacheslav Volodin, the speaker of the Federation Council Valentina Matvienko, as well as a group of deputies and senators. It provides a systematic processing rules remote operation, the availability of their application, the possibility of combining office and remote work.

The initiative proposes to introduce three key concepts. The first remote (remote) operation, the second temporary remote (remote) operation: this mode of operation provides for temporary implementation of the labour functions of an employee working under an employment contract, outside the stationary working place, under the control of the employer, the third - combined remote (remote) work: full employment in the workplace and distance (remote) work.

The draft also proposes to waive the requirement to sign an employment contract on remote work with the use of qualified electronic digital signature (EDS). According to the authors, today the cost of such EDS restricts the spread of telecommuting. At the same time as the employer and the employee in all cases it is proposed to provide the opportunity and the right choice, so that they could use the documents on paper.

In addition, the draft proposed to exclude from the section of the labour code on remote working a number of redundant and outdated regulations and standards, not subject to labour legislation.

"So, eliminates the provision stating that providing mandatory insurance coverage for compulsory social insurance against temporary disability and in connection with motherhood remote worker sends the employer the originals of the documents stipulated by Russian legislation, by registered mail with notification. Excluded the provisions relating to employment records," - said in the explanatory note to the project.

It is also proposed to eliminate the requirement to identify the workplace as one of the terms of the employment agreement on remote work and streamline a number of regulations on peculiarities of working time and rest time remote worker. In addition, provides for the right remote employee and of an employee in a temporary mode remote operation to be "offline".

As expected, in the first reading the bill will be considered by the state Duma on July 21.

In addition, at the plenary session the parliamentarians will have to adopt a draft resolution, also approved at the meeting of the Committee. The document is available twice a deadline for the submission of amendments to the bill - 60 instead of 30 days. Also for the revision of the document will be created working group that is expected to be headed by first Deputy Chairman of the faction EP Andrey Isaev.

The draft resolution the working group will also be encouraged to study the definitions, identifying the types of works to consider the possibility of forming a separate section of the Labour code about the "distance", to clarify the reason of the transfer of the employee to a temporary remote work, consider the introduction of additional grounds for termination of the employment contract on remote work. it is also proposed to further discuss and explore issues related to the determination of the conditions of use of the equipment and software and hardware tools owned by the employee and provided by the employer, the establishment of the regime of working time and rest time of employees, organization of interaction of the employee and the employer during working time, priority of certain categories of workers in temporary remote work in the event of unforeseen circumstances, the provision of guarantees associated with special conditions in the temporary remote work, as well as features of the conditions and protection of workers.

The Committee on labour and social policy will have to finalize the bill taking into account the submitted amendments and to submit it for consideration the State Duma in the second reading during the autumn session the year 2020.
