Russian banks have offered to provide data fraud victims

The Association of Russian banks (ADB) proposes to freeze at 25 days received a potential Scam transfers, and to transfer their personal data to their victims, to have been more likely to return the stolen funds to the bill, which is available to RIA Novosti.

In February, the Central Bank said that banks return to Russia only every seventh ruble, translated without their consent, that is, 15% of the total amount stolen. The low level of compensation is related to the fact that many of the clients themselves give information to scammers who use social engineering techniques. And if the client is compromised the data card or remote banking service, the Bank has the right by law not to return him the money.

In June the head of Bank of Russia Elvira Nabiullina noted that about 70% of the fraudulent transactions, are performed using social engineering. Currently, all that can make the victim of fraud is to contact the police and try to prosecute. At the same time to return the stolen money from the card in most cases impossible.

Association of banks of Russia drew attention to the inconsistency of the current legislation incident to the acceleration of financial transactions, which does not allow properly to counter fraud. For example, "freezing" questionable payment currently is two business days.

ADB, first, proposes to give to the beneficiary's legal ability to block the funds if the originator's Bank has received a notice challenging the transfer. Secondly, the Association proposes to provide a real opportunity for the potential victim to obtain documents that will allow for long-term authorization of funds for the execution of a judicial decision or sentence.

"The beneficiary's Bank when it receives notification (challenging operations – ed.), blocks funds for the beneficiary's account in the amount of the disputed transaction. The lock period is 25 working days", - stated in the materials of the Association.

"We offer to do automatically lock when you get this message," - said RIA Novosti head of the legal Department of the Association of banks of Russia Sergey Klimenko.

In addition, ADB proposes to transfer to the payer recipient information, i.e. personal data. This is to ensure that the victim of fraud could apply to the court within the framework of civil or arbitration proceedings. Such a claim allows you to file a petition for his support, one way of which is the seizure of property belonging to the defendant, such as funds in a Bank account.

"But filing a claim and statement of claim is impossible without specifying of the name and place of residence of the defendant individuals and full company names, addresses, location and PSRN of a legal entity," explains the ADB in its document the need to transfer payer's personal data about the recipient.

The fact that the data which the Association proposes to transfer a potential victim of fraud, are banking secrecy. While in ADB give an example, when the right to receive information constituting Bank secrecy, is contained in a special law, in particular, this right of the liquidator prescribed in the law on insolvency (bankruptcy). Offered a similar right to provide in the law on the national payment system for those cases, if the sender disputes the transfer, says the Association.

In addition, in all cases, prior to enrollment and after enrollment are asked to provide five working days for recipient to inform the Bank that he does not confirm the operation. "In this case, the funds are returned to the sender without providing personal data and banking secrecy recipient of funds", - explains the essence of ADB's initiatives.

Klimenko told the news Agency that in the near future the project will be discussed with the banks, possibly with state authorities, and then after settling on the final version planned to make it "possible to the autumn session if it's okay."
