The court upheld the woman from Kursk bailiffs collected allowance

First, the cassation court of General jurisdiction rejected the Federal bailiff service of the complaint on the decision of the lower courts have taken the side of the inhabitant of Kursk region, which the officers had sought child support and payment for his food on account of debt, told RIA Novosti in court.

As follows from the published materials of the case, a resident of the Kursk region Oksana Kuprikov has filed a lawsuit against the Federal bailiff service of Russia and the Federal bailiff service in the Kursk region, demanding compensation for the damage caused by the actions of the bailiff. He seized her, and later sought him almost 83 thousand rubles. The woman indicated that the seized funds - this benefit is guaranteed by the family at the birth of a second child, as well as cash compensation for his meals.

Bailiffs in objections to the complaint indicated that the funds were on Deposit Kuprikova, not social, so they were written off as "the bailiffs are not required to identify the source of receipt of money resources into the account of the debtor." For this reason, representatives of the defendant asked the court to deny Kuprikova the claim in full.

In addition to the recovered funds, a resident of the Kursk region had intended to charge the police officers interest on her money, compensation for non-pecuniary damage, the cost of a lawyer and payment of state duty.

The court of first instance sided with the women, noting that for benefits and monetary compensation to the child's diet cannot be levied. Thus, Kuprikov sued the bailiffs 97 thousand rubles. This decision, despite complaints FSSP, prevailed in the appellate and cassation instances.
